The legislature of Schleswig-Holstein (Landtag) has enacted a law authorising the issuance of five online table game licenses and establishing a tax rate of up to 44% on gross gaming revenue.
The Landtag ratified legislation to enact the Fourth State Treaty on Gambling, permitting the provision of online casino games throughout Germany, rather than just in Schleswig-Holstein, for the first time upon its implementation in July 2021.
The Treaty permitted state governments to determine their own regulations for online casino table games. They may either establish a monopoly or grant a number of licenses equivalent to the state's land-based casinos. Schleswig-Holstein is home to five terrestrial casinos.
Under the new legislation, Schleswig-Holstein will adopt the latter strategy, permitting five online table game operators.
Hans-Jörn Arp, parliamentary secretary of the Christian Democratic Union (CDU), affirmed that one of these licenses would be allocated to the state-operated Spielbank Schleswig-Holstein, leaving four further licenses available.
He stated that these licenses would be granted "based on reputable and stringent criteria."
“We deemed it essential to avert the establishment of a new Las Vegas and to meticulously regulate the participants, their activities, and the flow of data and finances,” he stated.
The new legislation establishes taxes for online table gaming. Revenue up to €300,000 per month is subject to a tax rate of 34%, revenue between €300,001 and €750,000 is taxed at 39%, and revenue beyond €750,000 is taxed at 44%.
A new federal authority for gaming regulation has been established in Sachsen-Anhalt under the state treaty. Arp stated that it is imperative for all federal states to support this entity "before providers relocate overseas and our channelling plan is compromised."
The new regulatory authority has yet to authorise any online gaming licenses.
